We are lawyers for Auto Limited and write to you on its behalf. Our client instructs that a report was published by the Daily Graphic on Tuesday, March 10, 2015 without any recourse to it, resulting in a distortion of facts that impact on its image and is tantamount to a prejudicial interference with the administration of justice.

The matter in court stems from a facility our client took from Guaranty Trust Bank Ghana Limited, which led to a civil suit initiated on behalf of the bank by a lawyer not licensed to practise at the time the writ was issued; an issue which has been contested at the High Court, Commercial Division, Accra and is currently pending at the Court of Appeal,  Accra.

The application to recall a witness referred to in your publication was dismissed by the High Court, Commercial Division, Accra, after which the bank filed an application for a review which is yet to be determined by the court. It is the opinion of our client that the publication is intended to subtly put pressure on the court and prejudice the determination of the pending application for review, an act that constitutes contempt. These facts would have become apparent to your reporter had he conducted the enquiries at the court or from our client as required by your profession under the circumstances.
